Definitions
Professional Partner
A third party that uses personal information to initiate and coordinate a family relationship and/or paternity test case and who performs sample collections under the instruction of Genetica DNA Laboratories.

Collection Site
A third party that uses personal information provided to Genetica DNA Laboratories to perform sample collections on behalf of and under the instruction of Genetica DNA Laboratories.

Personal Information
Any information that identifies an individual, or could be used by or on behalf of Genetica DNA Laboratories, its professional partners, and/or collection sites to identify an individual; does NOT include information that is publicly available.

Sensitive Personal Information
Personal information such as race, ethnic origin, religious beliefs, or health/medical status. Genetica DNA Laboratories treats as sensitive personal information any information received from a third party where that third party treats and identifies the information as sensitive.

Information you give us . We receive and store information you enter on our Web site or you provide to us in any other manner. We use the information you provide to us for purposes of initiating a test, scheduling specimen collection appointments, responding to your requests, improving our web site and system administration, and ensuring that only individuals with the right to access the information are able to access it. This information may be used by Genetica DNA Laboratories and our professional partners and/or collection sites. This information could personally identify an individual.

Other information . We receive and store other types of information whenever you interact with us. Genetica DNA Laboratories uses this information for the purposes of completion of current activity, improving our Web site and system administration, and ensuring that only individuals with the right to access the information are able to access it. Genetic Privacy
Genetica staff believes that each individual has a right to genetic privacy, and should govern the use of his/her genetic information. Genetica only performs DNA parentage and family relationship tests on individuals with their knowledge and informed consent, or as directed by court order, regulation or as requested by a government agency. We conduct all aspects of DNA parentage testing and family relationship testing with strict confidentiality, and we safeguard the genetic information our clients entrust into our care.

Safe Harbor Privacy Policy
Protecting the privacy of all clients is important to Genetica DNA Laboratories. The U.S. Department of Commerce and the European Commission have developed a “safe harbor” framework that allows organizations in the United States, such as Genetica DNA Laboratories, to satisfy the European Directive’s requirements for client confidentiality. Genetica DNA Laboratories adheres to the Safe Harbor Privacy Principles for the protection of client privacy.

Scope
The Genetica DNA Laboratories “Safe Harbor” privacy policy applies to all personal information received by Genetica DNA Laboratories in the United States, as well as, from the European Union (EU) in any format – this includes information received electronically, in paper form, or verbally.

Individuals in the United States, in the European Union (EU), and worldwide whose personal information is collected by Genetica DNA Laboratories, its professional partners, and/or collection sites are conspicuously informed of the purposes for which it collects their personal information. In addition, those individuals are informed of the choices and means, if any, that Genetica DNA Laboratories offers individuals for limiting the use and disclosure of their personal information. In addition, individuals are informed that they may contact Genetica DNA Laboratories with any questions and/or complaints they may have in the course of interaction with Genetica DNA Laboratories.

Choice
Genetica DNA Laboratories offers individuals whose personal information is collected by Genetica DNA Laboratories the opportunity to choose whether their personal information is disclosed to a professional partner and/or collection site (unless required by contract or court order). In addition, Genetica DNA Laboratories offers individuals the choice to “opt out” if Genetica DNA Laboratories requests to use personal information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual.

For sensitive personal information, Genetica DNA Laboratories gives individuals the opportunity to positively and explicitly consent, using the individual’s signature, to the disclosure of the information to a professional partner and/or collection site OR the use of the information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual.

Onward Transfer
Genetica DNA Laboratories obtains assurances from its professional partners and/or collection sites that they safeguard personal information consistent with this Policy. If Genetica DNA Laboratories has knowledge that an affiliate and/or collection sites is using or disclosing personal information in a manner contrary to this Policy, Genetica DNA Laboratories will take reasonable steps to prevent or stop the use or disclosure.

Access
Individuals, upon written request, may access the personal information collected by Genetica DNA Laboratories, its professional partners, and/or collection sites and may correct, amend, or delete information that has been verified to be inaccurate, except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy, or where the rights of persons other than the individual would be violated, or as directed by a court order.

Security
Genetica DNA Laboratories takes reasonable precautions in protecting all personal information from loss, misuse and from unauthorized access, disclosure, alteration and destruction.

Data Integrity
Genetica DNA Laboratories uses personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual. Genetica DNA Laboratories takes reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current.

Enforcement
Genetica DNA Laboratories annually conducts an internal audit of its relevant privacy practices, policies and procedures to verify adherence to the Safe Harbor Policy. Any employee that Genetica DNA Laboratories determines is in violation of the Safe Harbor Policy will be subject to disciplinary action up to and including termination of employment.

Any questions and/or concerns regarding the use or disclosure of personal information should be directed to the Genetica DNA Laboratories Privacy Department at the address listed below. Genetica DNA Laboratories will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with the principles contained in this Policy. For complaints that cannot be resolved between Genetica DNA Laboratories and the complainant, Genetica DNA Laboratories agrees to participation in the dispute resolution procedures of the panel established by the European data protection authorities to resolve disputes pursuant to the Safe Harbor Principles.

Limitation on Application of Safe Harbor Privacy Principles
Adherence by Genetica DNA Laboratories to these Principles may be limited: (1) to the extent required to respond to a legal or ethical obligation; and (2) to the extent expressly permitted by an applicable law, rule, or regulation.

Changes to this Policy
Please note that this Policy may be amended to be consistent with the requirements of the Safe Harbor Principles. Genetica DNA Laboratories will post appropriate notice about such changes and/or amendments.
